Send Consumer Notice
As a consumer, you have every right to demand full value for the price you pay for a product or service. This means that if you are not satisfied with the quality of a product or service, you can file a case against the seller or service provider in the Consumer Court. However, the law says that before you can file a case, you need to send a notice to the other party. In consumer cases, this notice is known as consumer complaint notice. This notice serves two purposes. It informs the seller or service provider of your intention to file a case. It also provides them the final opportunity to rectify the deficiency in the quality of service or the product.
Definition of Consumer
In India, the Consumer Protection Act, 1986 governs all provisions of consumer protection. Under this Act, the consumer can file a case as well as send a notice. Therefore, it is important to understand the meaning of the term Consumer first.
As per the Act, consumer is any person who buys goods or hires services for a consideration. It also includes a person who avails services or uses goods purchased/hired by another person. Moreover, the consideration may be paid, promised, as well as deferred. The definition of consumer under this Act does cover commercial use of such goods or services.
Further, there are some other persons who may make a complaint under this Act and therefore need to send a notice as well. Such persons are:
- Central or the State Government
- Legal heirs or representatives of a deceased consumer.
- A registered voluntary consumer association.
- One or more consumers, in case of numerous consumers having the same interest.
The word Person includes an HUF, association of persons, society, and firm.
Contents of a Consumer Complaint Notice
It contains the following details:
- Index which lists the contents of the notice
- Details of the sender of the notice as well as the consumer(s) such as name, address, e-mail etc.
- Facts of the complaint, in detail.
- The relief you seek from the seller or service provider.
- A reasonable time limit for providing the relief.
Documents for Consumer Complaint Notice

- An affidavit stating that all your claims are true.
